Should I file my LLC myself, use a service, or hire a lawyer?

Last updated September 27, 2026

Compare filing yourself, using an LLC service, or hiring a lawyer so you can choose the right help for your situation.

You can usually file a simple LLC yourself, use a formation service for convenience, or hire a lawyer when your situation has legal complexity. None of those choices is automatically “best.” Filing yourself can be fine if you know your state, your business is straightforward, and you are comfortable reading instructions. A service can save time, but you still need to know which add-ons are optional. A lawyer is worth considering if there are multiple owners, investors, unusual ownership terms, regulated activities, intellectual property concerns, or a dispute risk you already know about.

Steps

  1. Decide how complex your business is. A one-owner local service business is usually simpler than a multi-owner company with investors, profit splits, or ownership vesting.

  2. File yourself if you want control and can follow state instructions. You will usually go through your state filing office, choose a name, appoint a registered agent, and submit formation paperwork.

  3. Use a service if you want help with the filing workflow. This can be helpful if you do not want to navigate the state site alone. Read the checkout carefully so you know what is required versus optional.

  4. Hire a lawyer if the ownership or risk is not simple. A lawyer can help with an operating agreement, partner rights, buyout terms, liability concerns, contracts, and state-specific legal issues.

  5. Talk to a CPA or tax professional for tax questions. A lawyer forms the legal entity. A CPA can help you understand tax elections, bookkeeping setup, estimated taxes, payroll, and sales tax.

  6. Do not buy help just because you feel behind. Match the help to the risk. Simple filing help is different from legal advice or tax planning.
