Do I need an EIN if I am a sole proprietor?

Last updated September 27, 2026

Learn when a sole proprietor needs an EIN and when using your personal tax ID may be enough.

If you are a sole proprietor with no employees, you may not need an EIN right away. Many sole proprietors can use their personal tax ID for federal tax purposes. But you may need an EIN if you hire employees, open certain business accounts, file certain tax returns, or if a bank, payment processor, marketplace, vendor, or license office asks for one. Getting an EIN does not turn your business into an LLC. It is only a tax identification number.

Steps

  1. Confirm your current structure. If you have not formed an LLC or corporation, you are usually operating as a sole proprietor by default. That means you and the business are not separate legal entities.

  2. Check whether you are hiring. If you plan to pay employees, you will typically need an EIN before you register for payroll taxes or run payroll.

  3. Ask your bank or platform what they require. Some banks, payment processors, wholesale suppliers, and marketplaces ask for an EIN even when the IRS does not require one for your exact situation.

  4. Check license applications. Some city, county, or state license forms ask for either an EIN or a personal tax ID. Do not guess. If the form is unclear, contact the issuing office before submitting it.

  5. Apply directly through the IRS if you decide to get one. The EIN application is handled by the IRS. Make sure the legal name and owner information match your current business structure.

  6. Update your records. Once you have an EIN, use it consistently on business tax forms, bank forms, vendor forms, and license applications when requested.
